Legal Question in Bankruptcy in Florida
One spouse filing chptr. 7
would like SPECIFIC info on this subject. my husband will not help with this finacial load. my income has been cut substantially. i need to know how i can file chapter 7 without his involvement. we have only the house, and one low balance credit card in our names together. i have nothing of any value, including a car. i can find general info in the law library, but no details. i'm sure there is more to it than i can find.

There is nothing toprevent you from filing your own individual petition in bankruptcy. You may list joint obligations and be discharged as to your liability. With regard to secured creditors, they must be paid or be maintained in a current status or the security must be returned to them. If you wish to discus this matter further, call me at 305-940-8080
