Legal Question in Bankruptcy in Florida

Can I start my life over?

This is simple, I have to pay back school loans and about $30K and $8K in credit cards. I am currently still seeking for a JOB that pays more than just a "value meal" Now, I cannot keep up with too many bills I think I should have been more carefull of my actions. I only have a computer and a car under my name which they had been paid off long time ago, is there any remote chance that after filing for bankrupcy I get those belonging confiscated, and if I have a joint savings account would that too be taken away form me? What are the downsides of filing for bankrupcy? Can I come out of this in one piece or I am better off sacrifice my self for the next 20 years paying off those loans?

Re: Can I start my life over?

When someone files for Bankruptcy there are certain exemptions permitted. This means you are permitted to retain a certain amount of personal property which can not be taken away from you. We would have to discuss what the balance of your accounts are, what items of personal property that you own and real property. There are a lot of factors to discuss. Depending on different factors you may have all of your credit card debts discharged. That would depend on if they are in your name only, what you purchased and when. We could discuss that. The law recently changed for student loans. You would most likely have to pay the student loans back. But to make a final determination I would need to know what type of loans they are and when did you take out those loans. Please feel free to contact me at (954) 437-5968 for a free consultation. Good Luck.
