Legal Question in Bankruptcy in Florida

Student Loan Discharge

I filed bankruptcy(Ch7)on 9/4/98 and it was discharged on 12/24/98. None of the creditors diputed the filings. Included in the filings was my student loan which became due on 4/1/85, it was dicharged. Know the creditor for the loan is claiming that I couldn't have it dicharged, a year after the original filing and it meet all the criteria for discharge 7yrs and a hardship. Please advise as to how to proceed to stop this harassment.

Re: Student Loan Discharge

I suggest you call me for an appointment. At that time, I would review your documents to be certain that your discharge included the student loan. If so, you may have rights against the 3rd party collector under various provisions of Federal Law. You may reach me at 305-940-8080.
