Legal Question in Bankruptcy in Florida
Tax refund and Chapter 7 bk in Florida
I filed on 12/23/03 Chapter 7 in Florida. My trustee said that he will not grant me a discharge until he sees my 2003 tax return. I am going to file jointly with my wife, who did not file BK. We are expecting a refund. Will the trustee take ALL of my refund? Thank you.

If you can establish that the refund belongs to the non-bankrupt, then it should not be part of the estate assets.
