Legal Question in Bankruptcy in Florida
I am thinking about filing an individual chapter 7. All personal property including the household furniture and furnishings were purchased with funds coming from our checking account which is owned by the entireties. Is all such property exempt in Fla.
1 Answer from Attorneys
Based on my understanding of the basic facts described in your question, my reply is:
Under Florida bankruptcy law, up to a thousand dollars is protected from creditors, including an additional thousand for a spouse. West's F.S.A. Const. Art. 10 4(a)(2); Also, the amount of your personal exemption may depend on your treatment of homestead exemption.
It is unclear what is meant by purchases from a "checking account which is owned by the entireties" but this appears to be irrelevant to the issue of property exemption.
