Legal Question in Bankruptcy in Florida

Trustee and unsecured debts

My husband filed bankrupty because of loss of job and large secured debts, with few unsecured debts such as credit cards. The question is, can the Trustee collect/take more than what the unsecured debts total? We have less than 5000.00 in unsecured debt and all the secured debts have taken the items. The trustee so far has totaled up our assests to around 15,000.00, where would the extra money be paid to?

Re: Trustee and unsecured debts

Upon filing, all your non-exempt assets become the property of the Trustee. If there is a surplus after all expenses, trhat should be returned to you. You need consult with competent bankruptcy counsel.
