Legal Question in Bankruptcy in Florida
I still have my vehicle........you just aswered this, but since the finance company has not come to repo my car after 10 months and it is in a charge-off status, are they aware that i still have the car since no attempt has been made to get it?
Last, I have not paid on it, so can i include the entire past due balance in my chapter 13 bankruptcy and keep it & start making payments, or will they take it?

Yes, you can put the past due balance in your chapter 13 plan and keep the car. When you file for chapter 13, you'll have to start making the regular payments on the car. Don't miss a car payment or a chapter 13 payment, or they'll take the car.
