Legal Question in Bankruptcy in Florida
Me and wife were going to file chapter 7 together, but then only she filed days before we were both due at a trial as defendants against a credit card collection attorney (after already pleading not guilty/denying it). On day of trial, called CoC & was told case was dismissed. Even though only she filed for chp. 7, can they persue me lateri after they dismissed the trial date altogether and only she had filed?

You would want to see whether the case was dismissed "with prejudice" or "without prejudice". The later leaves open the possibility that the credit card company could initiated a lawsuit against you (as joint owner) before the running of the statute of limitations. Hope this helps.
