Legal Question in Business Law in Florida
I am and ad sales exec in Florida and over three times the companies I sold ads to defaulted on the contract. The company I work for made me pay back the commission, the company I work for doesn't have a so called collections department just a controller.
Is it legal for them to make me pay back the commission.
I did my job and it is not my fault the companies I sold to did not pay or send in the creative for the publications. The companies I sell to are multi-million to multi-billion dollar companies that can afford to pay. It is the lazy controller who did not try to collect the debt.
So is it legal for them to make me pay back the commission?
1 Answer from Attorneys
As a Franchise Attorney I can say the answer is probably no. But it depends on a number of factors. You should contact your local employment development or labor department. They will advise you and take action, if appropriate. Consult with a good business or franchise attorney in your area for specific advice.
