Legal Question in Business Law in Florida
Looking for advice on a business partner split. My partner and I have a 50/50 split in a company. He has done significantly less work (example: missing almost 3 months� worth of time last year) and after 2 years I would like to split. Our partnership agreement expires in a few months and I saw that as the optimal time to part ways. I would like to take my current employees and set up a new company doing the same business with our existing clients and relationships. One thing is that all our employee agreement signed a non-compete and non-solicitation on being hired. I assume that if I do not renew our partnership agreement and the company is forced to dissolves, then prior non-competes are void which would allow me to form a new organization. Would this be the correct way to handle the situation?
