can autopart company charge restoking fee without any agreement beteen company and buyer. transaction was made by credit card in tha company office.

There was probably an agreement under the UCC. Look at your paperwork and I am pretty confident that you will find the fine print. If there was "no agreement," then they have no obligation to take the return.
