Backing out of consulting service contract

I signed a service contract for consulting services for approximately $3100 on 9/01 for work to be performed 3/02 and now realize it is a losing proposition for me. The client is pressing me to do the job for the $3100 and I am willing to do it for $3500 or not at all. Can I flat refuse to do the job without repercussions?

If you agreed to a bad deal, and no one put a gun to your head, then you run the risk of being sued for breach of contract for failing to abide by the terms of the deal. For example, if a lawyer agrees to charge a client an hourly rate of $200, but later realizes that he/she should have charged $275 because the case is more complicated than originally anticipated, that's too bad, unless of course the client agrees to a change in the hourly rate. The lawyer is obligated to charge what was agreed.

Similarly, you need to abide by the agreement. If the other party agrees to a change in price, no problem. If not, you have a problem if you refuse to move forward as agreed. You have to consider whether $400 is worth the risk and costs of getting sued. Good luck.

The wheels of our society turn on the basis of integrity. So, you made a bad deal, we all do. Many times I have quoted professional fees and had a lot more work than anticipated. Live up to your end of the bargain and be the better for it.
