Billing Records Dispute
I own a small billing service for mental health professionals. One provider owes me many months in back fees. He is now changing from my billing service to another. He would like a DVD of all his billing records from my medical billing program.
I wish to send him the records after he pays me what is due to me. He wants the records immediately and wishes to make payments to me over 3-4 months. Provider says it is against the law not to send him his billing records now. Can I withhold the info until I receive payment in full from him for my services

Against the law? I don't know why it would be so. Was he sent copies of the biling records as they went out? He could have kept a copy then (or they have already been provided). If you want a middle ground, give him the records but have him and his company sign a promissory note so you have an easy mechanism to sue if he does not pay you. Be sure to include an attorneys fee clause in the event of suit.
If he won't sign, then ask him why you should trust his promise to pay on faith alone.
