Legal Question in Business Law in Florida
I am a boat owner. I took my outboard for a repair. As a result of an error on the part of the service facility my engine blew a cylinder during the final sea trial by the dealer. What are my rights.
1 Answer from Attorneys
If it was the fault of the service facility, then they will have to correct their mistake. If they will not assume it is their fault or will not correct their mistake, you will have to sue to recover your damages. You will need to take the boat to other reputable mechanics to document the damage and have their expert opinions that the repairs were done negligently and the repairs caused the further damage. You will also need several documented estimates to correct the damage.
Depending upon the amount of the damages, you should be able to sue in small claims court without an attorney.
