Legal Question in Business Law in Florida
Is this a breach of contract or something else entirely?
I was offered a settlement agreement by a former employer in which they would repay 6 weeks of my unpaid wages and my outstanding expenses in exchange for a return of my equipment. I returned it by the deadline, signed the agreement, and received an email from the CEO acknowledging receipt of everything due and stating "we will take care of our obligations". No senior executives were present to sign the agreement from their side, and the VP of IT stated it would be signed "that evening".
The settlement stated they would repay the monies on execution of the agreement. It has now been three weeks, and both their counsel (who originally made the offer and stated two weeks ago he would "check on the delay" without responding subsequently), and the CEO are ignoring all communications.
1 Answer from Attorneys
Breach of implied contract and unjust enrichment.
