Legal Question in Business Law in Florida

Breach of Contract

I received a job through an employment agency (yes, I signed all the forms finalizing it). A week before I was about to start, I landed a job double the salary of the agency's. I called the company as well as the agency to let them know and give them enough time to find a replacement. In that week's time, no one from the company nor the agency contacted me. I made several more attempts, only to be ignored each time. A couple weeks later I find out I am being sued by the agency for a percentage of my expected first year's salary. I understood where they were coming from, so I wasn't really trying to fight it. Since I only had $2000 (they wanted $4K)in the bank, I asked them if they would be interested in letting me pay them $2000 and call it even, or if I could pay them $100 over 44 months. I didn't think I was being too unreasonable considering their elusive nature when trying to change jobs. They refused my offers and insist on taking me to court, AND demand that I pay the collection and lawyer fees. Is there any way out of this one? Or any way to lessen the blow to my bank account?

Re: Breach of Contract

I would need to review all the forms you signed before being able to give you any meaningful advice. However, it appears that your attempts to give the agency notice and your settlement offer were reasonable. Do not sign anything without having a lawyer review it and, if you are sued, seek legal counsel counsel immediately.
