Breaking a legal contract

I signed up with child support network to assist in getting past due child support and signed a legal contract. In the contract it states that they get 35% of any child support I receive. The child support that I am now receiving is because the state stepped in and had his wages garnished. Is there any way to break the contract with them as any money the state sends me I still have to send child support network 35% even though it is not being paid to them.

If the state stepped in due to the relationship with this agency they you may owe them. However, depending on the terms of the contract if they were unable to help you then you may not owe them and the contract may not be enforceable.

Although I have not read your contract it sounds as if it would violate public policy of child support. I doubt a court would enforce it.

I believe such contract violates the public purpose of child support. So although I have not read the contract, I question if a court would enforce it.
