Re: a business name
Former owner should not be able to use the name if you purchased a business entity registered and in good standing with the state and not simply the company assets. The company name is part of the good will that should be mentioned in your agreement. If the business was a sole proprietorship and not registered with the state, then you will need to look to your transfer agreement for support; it would come down to what a court believes you bought. Any commercial use of the name would conflict with your use of the name and could result in your liability for their actions if you do not stop them. You should consult with an attorney to review the facts and seek court assistance if appropriate.
