Business contract
My husband and myself are buying a lunch truck who services a route which is being sold to us as part of the contract. But come to find out the owner, has only a verbal contract nothing in writing, which he has stated to us verbally that he did have a written contract for this particular route. The owner who is selling us the lunch truck and route for 53,000 can he do this if he has no written contract or anything in writing to state so. My concern is that now he realizes that this particular route makes a considerable amount of income on a daily basis is now trying to get us out of this route. What can I do or what are my rights. The contract signed is not a contract drawn up by an attorney, It is some computer generated one from a program bought at office max. HELP ALL IS SEEK IS SOME INFORMATION OF WHAT MY RIGHTS MIGHT BE.

Sounds like you are buying nothing. What is to prevent his customers to refuse to do business with you? What is to stop him from starting a new route next month taking away your anticipated customers? You should have a lawyer advising you. Good luck.

Alll tht there is to sell, at best, is a route with possible customers all of whom are not required to do business with you or to use the product or service you will be selling. You need to consult with competent counsel in order that your interests be protected. The 'computer' formn contract is not ipso fact bad. But is it not anything that cannot be amended to provided for your needs.

Without a written contract, you will have a difficult enforcing your "rights" to this route. However, a contract does not have to be prepared by an attorney. But, you may need an attorney to review the contract you refer to in order to make sure it is clear and you would be able to enforce your rights to this route.
