Case Removal to Federal Court
Can a contract dispute action that has already commenced (landlord/tenant) be removed from circuit civil court to federal court by the defendant in the action?
The citizenship of the parties is currently not diverse since both parties are in the same state. Although when the conflict arose there was diverse citizenship. The matter in controversy is above $75,000. It's just not clear if this matter can be removed to federal court only on motion.

Not if there is no diversity of citizenship.
