Collection of debt

I have 3 separate contracts totalling about $110K with an individual that was to pay an interest payment on each every 50 days. I have not received a payment in over a year and now cannot get my principal back. Individual claims financial difficulties and promises repayment constantly...but always fails to come through. Would like an idea of chances for successful recovery and estimated cost factors.

I reside in Canton, GA 30114. Individual resides in Ft. Lauderdale, FL

Depending on the terms of the contracts and the facts, you may have to file in Florida. Either way, a well-worded demand letter from an attorney may help resolve the situation without the need for a law suit. However, a law suit may be required if the individual does not respond. Have a local business attorney review the agreements and the facts to determine your best course of action.

You may well have to file suit in FL. Howver, it is POSSIBLE that you could file suit in GA, but this is tricky. Based on what you said, winning the suit might not be that hard. Collecting may be another matter.

You will have to bring suit in Broward County, Florida. Collection will depend on what assets they have. You should be able to locate an attorney who will take the matter on a contigent basis. Good luck.
