Legal Question in Business Law in Florida
collection / judgement
I closed the books on a failing business over 5 years ago,is it possible for a merchant to have a judgement against me now? Isn't there a statue of limitations?
Shouldn't be against the law for someone to harrase you at home and work?

Re: collection / judgement
One would need more information to answer your question.
In Florida, judgments are effective for twenty years. Even
then, one could file an action to have the time extended.
There are laws protecting people from being harassed.
I suggest you consult an attorney.
Re: collection / judgement
If the claim was sued upon and reduced to judgment then there is a new s/l based upon the judgment. Your question omits some necessary details that are required if a full answer is to be provided. You may call me for information.
Re: collection / judgement
If the claims were against your business (corporation, LLC, or other entity), and not against you personally, then no judgment should have been entered against you individually. The judgment should be only against the entity.
If a final judgment was properly entered, then it is good for at least 20 years in Florida. However, no one should be making your life miserable at work or home. There are laws against that, and you'll need to consult with an attorney in that regard. Note that the judgment creditor has every right to take the deposition of the business's representative to learn whether the business has any assets that it can attach to collect on the judgment, and that is not considered illicit or harrassing in any way.
Seek the advice of counsel and good luck.
