Legal Question in Business Law in Florida
Company Name Infringement
I started a business and chose and registered the name Orlando Photography. Recently Orlando Photo has sent me an Email saying I am infringing on their name and they will pursue legal action if I do not change my name. They do not have a tradmark on their name. They state that they have ''common law trademark'' since they have been in business for several years in the area. Do they have a case against me?

They may well have a case. I suggest you consult with an attorney now about how to readjust your business assets to avoid this type of thing reoccurring. I deal with these types of issues frequently.

My educated guess is yes. Consult with local counsel and change what is necessary.
