Legal Question in Business Law in Florida
no compete clause
I have a no compete clause with a company that I was 5% owner of. I left that company in July of "99". Lask week a former client of thiers approched the company I work for now (not me personally)about doing some work for them. The clause is for 12 months after I left. My question is, if I was to do some of this work and the other company finds out what can they do to me? would the sue me for money or to make me stop doing work for one of thier former clients? please advise.

Re: no compete clause
The former company could sue for damages and could seek
injunctive relief. The chances of it succeeding
depends upon the wording of the contract. In addition,
there is a Florida Statute that governs such contracts.
An attorney would have to review your contract and
this statute before he or she could give any meaningful
advice.
