The better practice would be to create a contract between the two of you which would specifically address this issue.

Generally, work created by a graphic artist for you becomes your property. However, you should enter into a work-for-hire agreement with the graphic artist to ensure that all of the rights to the character or design are yours to own and exploit. An experienced intellectual property attorney can assist you with this.

Draft a contract in which the artist specifically grants you the intellectual property rights to his work.
