corporation or sole proprietor
We wish to sue a local contractor because we paid him for work that he didn't complete. We just discovered that he was incorporated (under another company name) with a partner but the paperwork containing his estimate was in his name only with another company name. Now he is saying that we cannot sue him as an individual because he was not a sole proprietor at the time and not eligible to enter into a contract. Is this true? What recourse do we have?
