Legal Question in Business Law in Florida
We have a customer who comes in and brings her small kids and one of the boys is very ADD and jumps, run, clime, and touch things all thru the salon, we have tried to cope everytime but is getting out of control with the tense and screaming, etc. Last time she was here we ask her to please not to bring her kids because liability purpose as we afraid he will get hurt. SHe answer as as we are been descriminated because she said her kids has problems, i told her is liability purpose and for the safety of her child, she insisted that we been descriminating her child, we here at the salon have no problem with kids as long they behave but her kids are too much. How should we handle this matter. Thank you

Based on the facts described in your inquiry, you are not discriminating in any illegal manner with respect to the customer. Businesses have a legal duty to manage their premises in such way to provide a safe place to conduct business. You may have rules of conduct relating to customers, including their children. Such rules are not discriminatory in any illegal manner (religion, ethnicity, race, etc) but are merely required to safeguard the interests of all customers. You may post rules which make the parent responsible for the behavior of their children and to remove any children who are create problems for other customers who also have rights. Although a child may have a psychological issue which makes control difficult, it is still the parent's responsibility to obey rules of conduct. You may benefit from discussing this matter with a local attorney familiar with such issues as well as with owners or operators of similar businesses.
Should an incident occur, obtain the names of all witnesses.
