Legal Question in Business Law in Florida

Delivery of subcontract pay

To Whom it may concern, I want to start out by saying thank

you for this service. My question has to do with a cleaning business that my husband owns. He got a lady to help him who wanted to take many smoke breaks etc, and quit after working only 15 hours for the business. She has demanded that we drop off her paycheck during certain hours at her primary place of employment. We have told her that we can meet at another location or that she can pick it up at our home which is the business address. She has refused to do that. My question is, is it are responsibility to go where she has requested? Also, if we send a registered letter to her at her place of employment (only address we have)and to notify her that she can call and make arrangements to either pick up her pay at our business address or somewhere else, and that she would have to sign for it, would that cover us?( Is it o.k. to send registered mail to someone at their work address?)What are our obligations as a business owner? Also she will be given a 1099. Thank you!!!!

While I believe the rule is that an employer needs to only make the check available at the same time and place that it ordinarily makes the payment in accordance with its customary payroll period, you may want to call your local Department of Labor, Wage and Hour division and ask them all your questions. They will be more than happy to answer all your questions over the phone. Good luck,

Randall Gilbert

Re: Delivery of subcontract pay

I see no problem in sending it to her by certified mail if she doesn't want to pick it up.
