Legal Question in Business Law in Florida
district court or small claims
I have a claim for about $8000 against a Jacksonville company.
Assuming I have a good case:
1) Are there additional costs to use district court?
2) Do I need a lawyer present at the trial or pre-trial conference?
3) Is there a pre-trial conference like small claims has?
4) Does filing of suite, pre-trial conference, and court all have to have personal representation? I am out of state.
5) What is the filing fee?

If the amount of your claim is for $8,000, you cannot go into Federal Court - if it is $80,000, then yes, you can go into Federal Court if you are a resident outside of Florida. If your claim is for a company, Florida law requires that you must be represented by a lawyer (it is how lawyers stay in business). If this is a claim you personally have against this business in Jacksonville, then you can represent yourself. The filing fees depend on every county in the state and depends on the amount of the claim.
