Legal Question in Business Law in Florida
Can I have dual residency in both Florida and NY?
Hi. I'm a NYS social worker and I'm moving to FLorida next week. I will be working as an independent contractor and will declare residency there. Can I also keep my residency in NY if I might come here for a few months a year and work as a short-term counselor? Or will it be sufficient to just keep renewing my NY license as a social worker ? Do I need to be a resident of NY to practice as a social worker here once I move to FLorida? I believe you can be licensed in both states. Thank you for any help.

I. You need to check with the licensing authority for C.S.W.'s in Albany as to whether or not you must maintain aresidence here or office here and or bank acct.As to living here, the primary residence provisions of the Rent Stabilization Law, ifyou live in a rent controlled apt. would govern, as well as case law. It is far toocomplex an issue to discuss here; whether ornot you could keep your residency at yourcurrent address depends on the nature of thetenancy and the feelings of the Landlord.
While you can be licensed in both states, each has its own requirements as to residencyissues. Better check with BOTH Fla and NYlicensing officials.
