Legal Question in Business Law in Florida
Employee contract and notice
My wife is employed by a Florida company. she has an employee contract that states she must give 60 days notice before she resigns. this company has since filed bankrupcy and has been late many times paying her and has also held one of her checks (which is in violation of her contract). she has now found a new job but they require her to start soon and she can only give 2 weeks notice. her current employer has threatened to sue us for not giving the full 60 days notice. can they win this? and what could they actually sue for? what can she do?

Re: Employee contract and notice
You failed to indicate what type of bankruptcy, reorganization or liquidation.
Read her contract to see what prohibitions and the remedies therefore are specified.
