Employee Theft via credit card purchases
Employee hired to start up & manage construction division of my company at an agreed upon & documented salary plus, 1 tank of gas per week (gas was verbally agreed). Job Description included aquiring new construction accts.
Company credit card was issued to make purchaes for clients.
We also loaned him several thousand dollars because he was going to loose his rental home etc. (some monies have been paid back).
Employee aquired 1 account for my company in 4 months. Employee made $30,000 in personal charges on our credit card during these 4 months. When confronted he quit.
We soon found out he was starting his own business (during his employment with me) with the help of the new customer he aquired while employed with me. That customer, of course, is gone.
1. He still has property that belongs to the company (isn't this theft?).
2. How can I get back the 30K personal charges he made on our cc's (isn't this theft also?)I have aquired most to the receipts.
3. Do I have any recourse regarding the 500K account he stole while working for us?

I would contact a local business attorney. Sounds as if you have several causes of action against the former employee.
