If I find a picture of a cat on line can i use it in maketing and to establish a registered trade mark. The picture was found on a public photo site.

No, not without specific, written permission. Whoever photographed the picture or drew the picture has rights to it.
Please do not invest your business funds in using a trademark before having it cleared by an intellectual property (trademark) attorney.
