Legal Question in Business Law in Florida

Florida Civil Case involving family

My brother and father filed a frivolous law suit against me over 2 years ago and claim they were managing members and owners of my real estate business. They had no brokers license or contributed money towards business and there was never a written agreement.

Their attorney withdrew for lack of evidence and now have a new attorney. The hearing has been delayed as a result of the new attorney. How long can this hearing be delaye? I feel they are intentinally delaying the hearing date as part of their harrassement towards me hoping I will break down and settle due to high attorney costs.

Can I sue for legal fees for this frivolous case and is there a deadline restriction on how long this case can go on? It has been over 2 years...

Re: Florida Civil Case involving family

You really must address your questions to your attorney. Ask him if it is possible to recover attorneys fees in this case if you win. Ask him how long the next hearing/action or trial has been delayed (attorneys file motions for the extensions of time, and your attorney has those motions). If you have a 2 year on-going litigation (which is not unusual at all, by-the-way), no attorney in the world EXCEPT yours will be able to answer your questions because the answers lie in your files which your attorney knows and will share with you.
