Legal Question in Business Law in Florida

My friend went to jail yesterday for serving beer to a minor, but the thing is he owns a transit company and we give out free beer coupons that the people can redeem in the sponserd resturants. So any one who rides our bus that looks 21 or over we give a free coupon out. How could they arrest him for this?

This is a criminal question, not a business question. Though I do wonder, he didn't serve them the beer. The person redeeming the coupon would be. Need to talk to a criminal attorney or public defender.

The answer to your questions is very simple. Could they arrest him for that? Yes, evidenced by the fact that they did, in fact, arrest him for that. Was it a proper arrest? Or, more importantly, can he be convicted for the offense for which he was arrested? That is a thornier problem. Without more information, it is hard to give a definitive answer. My inclination, though, based on what information you have provided is no. He did not serve alcohol to a minor. Presumably, it is incumbent on the individual redeeming the ticket for the actual alcoholic beverage to ensure the recipient is over 21. That apparently did not happen, and the issuer of the voucher cannot be held accountable.

As a Franchise Attorney I agree with the other attorney answers. This is a criminal law question and the facts surrounding the arrest appear suspicious. Consult with a good business or franchise attorney in your area for specific advice.
