Garnish of Wages
My father was a sole proprieter of his tile installation company, and now I have taken over the company and incorporated the business. I hired my father as an officer of the corporation. when he was sole proprieter there was a short amount of time that he wasn't exempt from worker's comp, and the company he subcontracted for (my corp. also subcontracts for) was fined by worker's comp. Now the company is garnishing my checks for the fine, do they have the right to garnish my checks, since my father is an officer, or do i have the right to go in there and tell them they can't do that? they've also garnished my wages for the past two checks, will i be able to get that money back?

You should consult with competent counsel. If the liability is not that of the corporation, and the garnishment indicates that the corporation is the judgemnt debtor, then it would appear that all is improper. Seek advise as soon as possible. 305.940.8080.
