independent contractor
If I hire a independent contractor and tell him he will be paid when I receive payment, and I have not received payment yet and we do not have a written agreement am I responsible immediately for payment?

Because you do not have a written agreement, proving the terms of an oral agreement is not very easy unless everyone understood the same thing and wants to tell the truth. On the other hand, standard practice is for subs to be paid once the general contractor gets paid. Also contracts for more than $500 are generally required to be in writing, but if the subcontractor has already performed then they would still have a claim for fair compensation for work performed.
