Legal Question in Business Law in Florida
Can my landlord ban my wife from the building which houses my business. She was a former employee of the other business we share the building with. The landlord owns the building and his family owns the other business. There were no threats, altercations or fights after her termination, although she is viewed as a former 'disgruntled' employee.
1 Answer from Attorneys
The right of your landlord to ban persons from the premises depends on the
provisions of the lease, and whether such provision authorize the ban. If your wife
is a lessee, such ban would be doubtful. Some commercial leases in Florida
give the landlord general rights to prohibit anyone for very general reasons. As
a lessee, you or your business certainly have a right to receive an
explanation of the ban which appears to have a questionable basis.
