Legal Question in Business Law in Florida

Legal and Binding Contracts

I hired a roofing company to replace my roof. Not only has he not completed the job I also have water damage from a job that has been done incorrectely and it has been two months. I have contacted him several times without any satisfaction. I have done some research and tried to put a claim through his insurance and find out it has been cancelled because they found out he hires sub contractors which were not insured. I specifically asked him if he hires sub-contractors or if he has his own employers,I did not want the work sub-contracted out- He stated he has his own employers. I also found out the company he stated he owned for 30 years is no longer active. He signed the contract as the owner. What legal action can I take against him?

Can he be sued personally because of his misrepresentation on a contract that is not legal if the firm doesn't exist? How does he continue to pull permits and do other jobs without insurance? What recourse can be taken against this fraudulant contractor?

Re: Legal and Binding Contracts

You can report him to the state board, but that won't

give you any relief.

You can sue him and get a money judgment for damages

if you win. However, there may be problems with collecting.

Check to see what non-exempt assets the individual has.

Then try contacting an attorney who will agree to work

on a contingency basis.
