Legal Question in Business Law in Florida
Liability claim against a buisiness that is being sold
Assisted Living business had a claim filed 2 years ago-still NO court date-NO amount of suit disclosed-99% sure NO LAWSUIT--We are selling-buyer wont close until resolved -he is afraid they can sue him even though separate license etc.
Suit: Claim 92 year female slipped and fx hip at the facility--Yet family states it happened with them. Our liability coverage is 1 million per incident-If for some reason this did go to trial-can they go after the new owners assets. If so -how do we get our insurance to end this nightmare..so that we can close. 2 years since filed--6 months waiting to close!

I would really like to know more of your problem. The court records can be checked. Also, if it is an asset sale, liability can be obviated. But to provide a meaningful answer the documents must be reviewed and a personal conference occur. Regrets, no free conference is available. But if you wish, call me at 305-940-8080.
