Are LLC names preotected?

Hello -

I own an LLC in florida that was formed and registered in 6/30/04. Today I discovered that someone registered an LLC with the same name as mine in 11/30/04. Both LLC's are in good standing.

What can I do to get the other LLC revoked? As I understand it two LLC's cannot (should not?) have the exact same name and mine was formed on the earlier date.

You will need to file suit to force the other company to stop using the name. I am available to consult with you on this case.

Contact the appropriate State Department. If they made the error, they should be able to correct it.
