If a long distance company provider service is not satisfactory and customer have already complained several times and still not satisfied after several resolutions of the problem AND FINALLY DECIDE TO TERMINATE THE CONTRACT prematurely, is he legally responsible to pay the imposed early termination penalty?

As a Franchise Attorney I can tell you this is standard practice with these big companies. If you don't pay, they will report it on your credit standing. About your only recourse is to sue in small claims court for the amount of the early termination penalty. Consult with a good business or franchise attorney in your area for specific advice.
