Magazine Subscription Contract

Three years ago I ordered a magazine subscription for which I originally thought only lasted for three years. I was billed $28.80 per month for three years for a total of $1036, which I have paid. I got a call the other day saying that there is still two years left on the contract and that I must pay $28.80 per month for another 24 months, $691.

The company I ordered from recorded the original transaction and sent me a memo of the terms. There was never a written contract but the company tells me that I have an oral contract that is enforceable because they sent me the terms.

I would like to know if the contract is enforceable and if there is any way I can get out of it. Please help!!!

There is a statute which requires subscriptions to be in writing in order to be enforceable. I would need to research it in order to give you the exact statute and see if it applies to you, but due to hurricane Wilma, I do not have access. Good luck,
