Newd an attorney
This is the situation. Mr. Ocasio is currently incarcerated, divorced while incarcerated, judge ordered, that his business of which his ex-wife had power of attorney of, for proceeds, etc. to be split 50/50. The ex-wife sold business for $50k, who she sold to has paid $20k, and not paid the remaining balance. Mr. Ocasio, needs to file a suit for his entitled proceeds. Nothing has bee paid to him as of yet. He needs to know if his claim should be against his wife, or who she sold the business to? And he needs representation, preferably an attorney who will concede to being paid on the back end. His suit would be for $25K, plus legal expenses, with $5K going into an interest bearing account for their daughter to be used toward her college education, or until she is 21.

He would have two claims - one against the wife for her breach of her duty to him as his "attorney" and one against the buyer for breach of contract.
it would be unlikely that you will find an attorney to agree to be paid as you described.

The suit would be against both. You should be able to locate an attorney who would work on a contingency plus advance of court courts. Any attorney you hire would need copies of written documents supporting your claim.
