Non-Compete Agreement
I signed a non-compete agreement with an employer upon my hire March,2002. I was put in a management position that was to include a commission on top of my base salary. My employer refused to pay me my commisions for the final month (August, 2002) that I held this position claiming that I did not do my job. I have proof that I did in fact perform my job for the month of August as specified. My employer also did not decide to inform me of his refusal to pay this money until 3 weeks after I had completed the work for the month of August and 1 week after payday and told me via phone that he was not going to pay me. My question is can I fight the non-compete agreement based on his refusal to pay money owed to me?

Read the agreement. Does a breach of one part of the agreement invalidate the whole thing or are the provisions separate?
