Legal Question in Business Law in Florida

Non-Compete

My wife and I run a computer

consulting business in FL. We use

1099 subcontractors to support our

customers. The subs sign a piece of

paper that says those customers

and referrals from those customers

belong to us.

We recently have found out that

one of our guys is soliciting

business from these customers and

has often been paid for some

services.

He has taken and is still in the

process of taking thousands of

dollars in business from us.

We have all of the proof we need.

Th catch is that we do not have his

non-compete paperwork.

Do we have a leg to stand on?

If you have lost the non-compete, you are probably out of luck. He will say that he never and, in fac6t, refused to sign it.
