Legal Question in Business Law in Florida

I nsigned a contract with Equity Management Solutions Inc. ,found out from the sec of state they are not inc. but using a fictious name . contract states if vthey are unsuccesful in 12 months to working out a short sale,or deed in leiu , that they would refund $ 905.00 of the consultant fee .they say they dont have the money to refund the $ 905.00 .as far as i know they have not filed for bankruptcy.

should i file a small claims case after mediation?

I would not wait for mediation to file the claim. In my opinion, they do not sound legitimate or financially stable.
