Legal Question in Business Law in Florida

Nuisance

We have a person who has filed hundreds of charges to the NLRB against our business. This has been going on for 8 years now and the cost of researching all documentations needed by the NLRB has risen to over $100,000. Is there a law on the books in which we could file a charge against this person. I also want to add that 99% of all these charges have been dismissed. He also has stated that he doesnt care if he wins as long as it is costing our business money to defend these charges. I am entering into a position in the next few months in the business where I will have the authority to file charges against this person. Any help in this matter would be greatly appreciated.

Re: Nuisance

If you have evidence the person is knowingly making false

accusations, then he is committing a crime and you

can report the matter to the state attorney's office.

However, this is not the type of crime most state

attorney's offices are concerned with pursuing and will

probably tell you to seek remedies in civil court.

You can bring an action for damages resulting from

past actions and request an injunction prohibiting the

person from making any further reports. However, as with

most litigation, it can be costly, time consuming,

and there is no guarantee of success.

Re: Nuisance

Florida has a vexatious lawsuit law. If all of these claims had no merit you may be able to collect damages and obtain an injunction. If you need additional information please call me at 561 998 9401. Good luck.
