Official Distributor in the US

The official distributor of a product in the US do not want to sell to us, because of their marketing strategy protecting their retail big accounts, the product is international and I have found a distributor abroad, can the US distributor do anything to us if we sell the product but we do not advertise the brand?

Ah, the DIVERSION dichotomy: free enterprise vs. brand control. I am all too familiar with its intricacies.

I probably have a conflict of interest here as the corporations I represent vigorously oppose what you suggest. So, I'm not going to give you any opinions or advice.

For more information, just start by doing some research on the net. Big companies all have diversion policies and procedures, many of which are posted on their websites. Be wary of trademark and copyright issues, US customs issues, and some US government agencies' enforcement (such as DEA for diversion of pharmeceuticals and chemicals).

You should retain an attorney who is very familiar with this issue to assist you and protect your interests.
