paid a deposit for work to be done

I paid a 50% deposit for work to be done at my house, storm shutters. After the agreed time (3 weeks) still no work done. I called the man and told him I wanted to cancel. He assured me it would be done in one week. I told him to give that to me in writing, which he did. I gave him a week, still nothing. I cancelled and told him to give me a refund. He has been putting me off, giving me a run around for 2 weeks, and now won't return calls.

Also found out the the company he said was his, isn't. He's not even affilliated with them at all. Isn't that some sort of criminal act like fraud, or embezelment, since he is pocketing this money?

What should I do?

You can contact Mr. Stewart and bring civil charges and you can press criminal charges and report this guy to the BBB and the FL Attorney General.
